SUBSTITUTE TRUSTEE'S NOTICE OF FORECLOSURE SALE
WHEREAS, on June 7, 1985, Nell P. Delaughter executed a certain deed of
trust to Larry C. Smith, County Supervisor, Trustee for the use and
benefit of United States of America, acting through the Farmers Home
Administration, United States Department of Agriculture which deed of
trust is of record in the office of the Chancery Clerk of Franklin
County, Mississippi, on June 7, 1985, in Book 167, Page 744-749 and
re-recorded on November 13, 1985, in Book 168, at Page 750-755,.
WHEREAS, United States of America, acting through the United States
Department of Agriculture Rural Housing Services (RHS), formerly Farmers
Home Administration, the current holder and/or assignee, substituted
Halliday, Watkins & Mann, P.C. as Trustee by instrument recorded in the
Chancery Clerk's Office on December 27, 2023 in Book 2023, in Page
6200-6202, as Document 75965; and
WHEREAS, Default having been made in the terms and conditions of said
deed of trust and the entire debt secured thereby having been declared
to be due and payable in accordance with the terms of said deed of
trust, United States of America, acting through the United States
Department of Agriculture Rural Housing Services (RHS), formerly Farmers
Home Administration, the legal holder of said indebtedness, having
requested the undersigned Substitute Trustee in said deed of trust, will
on April 30, 2024 offer for sale at public outcry and sell within legal
hours (being between the hours of 11:00 a.m. and 4:00 p.m.), at the main
front door of the County Courthouse of Franklin County in Meadville,
Mississippi, to the highest and best bidder for cash the following
described property situated in Franklin County, Mississippi, to wit:
West Half (W1/2)
Lots 1 and 2 in Block 22 in the Town of Bude, Mississippi, including all
improvements situated thereon. Being in the Southeast Quarter of the
Southeast Quarter (SE1/4 of SE) of Section 19, and the Northeast Quarter
of the Northeast Quarter (NE1/4 of NE1/4) of Section 30, Township 6
North, Range 4 East, as per the survey of Ralph H. Posey, Registered
Land Surveyor, dated March 13, 1985, and attached hereto as Exhibit "A"
and made a part hereof as if fully copied herein in words and figures,
reference to which is made for all purposes.
Being the lands that were conveyed to Dodds Lee and Lottie Lee by
Central Lumber Company by a deed dated the 15th day of January, 1947,
and of record in the Office of the Chancery Clerk of Franklin County,
Mississippi, in Land Deed Book E-4, at Page 514.
Being the lands that were conveyed by Dodds Lee and his wife, Lottie Lee
to Daniel Woodrow Wallace by a Warranty Deed dated the 30th day of
August, 1966, and of record in the Office of the Chancery Clerk of
Franklin County, Mississippi, in Land Deed Book I-7, at Page 101.
Being the lands that are a subject of a Decree of the Chancery Court of
Adams County in Cause Number 31,292 styled in the Matter of the Estate
of Daniel Woodrow Wallace, Deceased, in which Decree it is adjudicated
that Laura B. Wallace be authorized, directed and empowered to place
said Decree among the Deed Records of Franklin County, Mississippi, as a
monument of title to the subject lands, which Decree is of record in the
Office of the Chancery Clerk of Franklin County, Mississippi, in Land
Deed Book S-7, at Page 542.
Being the lands that were conveyed by Laura B. Wallace to Claude Freeman
by a Warranty Deed dated the 1st day of February, 1984, and of record in
the Office of the Chancery Clerk of Franklin County, Mississippi, in
Land Deed Book V-7, at Page 681.
Subject to all valid and subsisting oil, gas and mineral leases,
reservations and conveyances of record in the Office of the Chancery
Clerk of Franklin County, Mississippi, affecting the subject land.
Subject to any and all utility, pipeline and/or roadway easements or
rights-of-way affecting the subject property whether such easements
and/or rights-of-way are of use or of record amongst the Records of
Franklin County, Mississippi

The purpose of the below technical specification is for the Franklin
County Board of Supervisors to purchase two mini hydraulic excavators
with auxiliary hydraulics and standard bucket which includes an operator
station which includes a radio and analogue display; 19,401 lb Operating
Weight; 14' 10" Dig Depth. Adequate cooling and fuel capacity shall be
provided for continuous operation during one full shift. Unit shall be
designed for digging, trenching, and moving material and shall arrive
with primary implement mounted and prepared for operation. Units
supplied to this contract specification shall meet or exceed these
requirements. Technical specification compliance and acceptance is
determined at the discretion of the Agency/Department's engineers and/or
staff. The supplied unit shall be new, and of the latest design of a
model in current production or an update of an existing model. The
supplied unit shall also be furnished with identical equipment, options
and features as listed below. It shall be furnished completely
assembled, fully serviced, and ready for immediate operation. The right
is reserved to reject any and all bids proposing to furnish equipment,
which, in the opinion of the agency's engineers and/or staff, is not
satisfactory for the Agency/Department's use in the proposed
application.

TECHNICAL BUILDING & FIELDHOUSE REROOFING" PROJECT NUMBER 24018 to be
opened on 21 May 2024." and addressed to Mr. Chris Kent,
Superintendent of Education, Franklin County School District, 41 First
Street, Meadville, Mississippi 39653. In addition, the envelope shall
list the bidder's Company Name, Company Address and all applicable
state and local license and registration numbers of the bidder.
Envelopes not so marked are submitted entirely at the risk of the bidder
as the Owner and Architect assume no responsibility for the premature
opening of any bid envelope by any employee of the Owner or Architect.
Proposals shall be submitted in duplicate only upon the blank proposal
forms provided with the specifications and must be accompanied by
Proposal Security in the form of Certified Check or acceptable Bid Bond
in the amount equal to at least five percent (5%) of the Base Bid: such
security to be forfeited as liquidated damages, not penalty, by any
bidder who fails to carry out the terms of the proposal, execute a
contract and post Performance and Payment Bonds in the form and amount
within the time specified. The Bid Bond, if used, shall be payable to
the Owner.
Bid proposals must be received on or before the scheduled time for
opening of bids and no bid may be withdrawn after the declared closing
time for the receipt of bids for a period of ninety (90) days.
All bids submitted in excess of $50,000 by a prime or Subcontractor to
do any erection, building, construction, repair, maintenance, or related
work must comply with the Mississippi Contractors Act of 1985, by
securing a Certificate of Responsibility from the State Board of
Contractors.
The Owner reserves the right to waive any irregularities, the right to
reject any or all bids and the option to postpone action and final
decision for a period of up to ninety (90) days.
